Terms of use and sale
Working draft 0.1 for legal review, not yet in force. Open points are marked [TO CONFIRM].
These terms are the agreement between you and Brotelo when you use brotelo.com and when you buy courses. Please read them before you create an account or place an order. You can save or print them at any time.
1 About these terms
These terms apply to the website brotelo.com, to the parent area and to the children's area, which the site calls the Learning panel. Together, we call them "Brotelo". They form a contract between you and TOPFED WEB S.R.L.
Our Privacy notice, our Cookie policy and our Withdrawal and refunds page also apply and are part of the information we give you.
If you are a consumer, nothing in these terms takes away the rights that the law of the country where you live gives you.
Brotelo is offered to families living in [TO CONFIRM: the countries served at launch, for example the EU, the United Kingdom, the Republic of Moldova and the United States, and any others such as Switzerland or Brazil].
2 Who we are
Brotelo is run by TOPFED WEB S.R.L., a limited liability company registered in the Republic of Moldova, IDNO 1026023125543, with its registered office at s. Pepeni, r-nul Sîngerei, MD-6234, Republic of Moldova.
- E-mail: [email protected]
- Telephone: [TO CONFIRM: a telephone number; EU consumer law (Article 6(1)(c) of Directive 2011/83/EU) requires one for sales at a distance]
- VAT number: [TO CONFIRM: VAT registration numbers (EU One Stop Shop, United Kingdom, Republic of Moldova) once obtained]
Our service e-mails are sent from [email protected]. If you reply to them, your message reaches [email protected].
3 Words we use
- Brotelo, we, us and our mean TOPFED WEB S.R.L. and the Brotelo service.
- You means the adult who holds the parent account.
- Parent account means the account an adult creates to use Brotelo, buy courses and manage child profiles.
- Child profile means a profile that you create in your parent account for a child.
- Course means an illustrated slideshow of 10 to 15 slides, followed by a final quiz and a certificate of completion.
- Consumer means a natural person who acts for purposes outside their trade, business, craft or profession.
4 Your parent account
4.1 Who can open an account
Only adults can open an account: you must be at least 18 years old. For each child whose profile you create, you must also be the child's parent or legal guardian, or have the permission of the person who has parental responsibility for that child.
Brotelo is for private family use. You open your account as a consumer, not for a business. [TO CONFIRM: whether schools, teachers or other organisations may use Brotelo; if so, separate business terms are needed.]
4.2 Signing up and signing in
You can sign up with an e-mail address and a password, or with your Google account. Sign-in is handled by Firebase Authentication, a Google service, and we never see your password.
Please give accurate information and keep your e-mail address up to date: we send order confirmations and important notices there. Each parent account belongs to one adult. [TO CONFIRM: whether two parents can share one account or link their accounts.]
4.3 Keeping your account safe
Keep your password secret, do not let children use the parent area, and sign out on shared devices. Tell us at once at [email protected] if you think someone else has used your account. You are responsible for what happens in your account, unless it is caused by us or by something you could not reasonably have prevented.
5 Child profiles
In your parent account, you can create a profile for each child who learns with Brotelo. A child profile has a nickname, an age or birth year and an avatar chosen from a preset list. We do not ask for the child's photo, e-mail address or phone number. [TO CONFIRM: the maximum number of child profiles per parent account.]
Children never have their own login. A child opens their profile on your device, from your parent account, with an optional 4-digit PIN that you set. The PIN keeps each child's profile separate; it is not a password and does not protect your parent account.
Each child profile keeps the child's progress, quiz attempts and certificates.
When you create a child profile, you confirm that you have parental responsibility for the child, or the permission of the person who has it, and you agree to our use of the child's data as explained in our Privacy notice.
You decide when and for how long your child uses Brotelo, and you supervise them as appropriate for their age. You can change or delete a child profile at any time. Deleting a profile permanently deletes its progress, quiz attempts and certificates.
6 Acceptable use
You agree that you, and the children who use your account, will not:
- share access to your account with people outside your family [TO CONFIRM: who counts as "family" for the licence, for example the members of one household];
- copy, download, record, sell, rent, publish or share course content, except as these terms allow;
- use Brotelo or its content in a school, club, paid lesson or any other commercial or public setting;
- use robots, scrapers or other automated tools to access Brotelo or copy its content, including to train artificial intelligence systems;
- try to get around our security, payment or access controls, or disrupt the service;
- create a profile for a child without the right to do so, or give false information;
- change a certificate or present it as an official qualification.
If these rules are broken, we may act as described in section 16.
7 Courses and prices
7.1 What a course includes
Each course is an illustrated slideshow of 10 to 15 slides with short check questions, followed by a final quiz and a certificate of completion. Courses are used online, in a web browser. Before you buy, the course page shows its topic, the age range, the languages available and the price.
7.2 The free course
The course "Digital Safety and Smart Screens" is free. You need a parent account to use it, but no payment. [TO CONFIRM: that the free course stays free without a time limit.]
7.3 Prices
- A course costs 9 EUR, 8 GBP or 10 USD, depending on [TO CONFIRM: the rule that decides the currency shown, for example the country chosen at checkout, and the currency for the Republic of Moldova and other countries].
- Prices include VAT where VAT applies. [TO CONFIRM: the VAT registrations needed before the first sale (EU One Stop Shop, United Kingdom, Republic of Moldova, United States sales tax) and the tax treatment in each country.]
- The total shown at the last step of your order is the price you pay. We do not add any fees, and we do not charge extra for paying by card.
- Your card issuer may charge its own fees, for example for a payment in another currency or to a bank outside your country. Our bank is in the Republic of Moldova.
- We do not personalise prices using automated decision-making.
- We may change prices for the future. A price change never affects an order you have already placed.
- When we announce a price reduction, the previous price we show is the lowest price we applied in the 30 days before the reduction.
7.4 Children do not buy
Only adults buy courses, in the parent area. The children's area shows no prices, offers or buy buttons, and we never ask children to buy a course or to ask an adult to buy one for them.
8 How to order
8.1 Ordering steps
Paid courses can be ordered once card payments open. [TO CONFIRM: the date card payments go live; until then, only the free course is available.]
- Choose a course and add it to your cart, or choose "Buy now".
- Sign in to your parent account or create one. Give your full name, e-mail address and country, and confirm that you are 18 or older. [TO CONFIRM: the final list of checkout fields.]
- Choose the child profile or profiles that will learn, or create a new one. [TO CONFIRM: whether a course is unlocked for the whole parent account or for one child profile.]
- Check the order summary: the courses, the total price including taxes, and the currency. You can correct any mistake at this point by going back to an earlier step or by removing a course from your cart.
- Decide whether you agree that access starts straight away. The box for this choice is not ticked in advance (see section 13.2).
- Accept these terms. Our Privacy notice explains how we use data.
- Press the order button, which is clearly labelled as an order with an obligation to pay, for example "Pay now". [TO CONFIRM: the exact button wording in each language.]
- Pay on the secure payment page of our bank (section 9).
8.2 When the contract is made
The contract is made when your payment is authorised and the order confirmation is shown on screen. [TO CONFIRM: the exact moment the contract is concluded.] We then send you an e-mail confirming your order, with these terms and, if you agreed that access starts straight away, a record of your consent and of your acknowledgement. If the payment fails, no contract is made.
8.3 Order records and languages
We keep a record of each order, and you can see your orders in your parent area, under Orders. You can conclude the contract in any of the eight languages of the site: English, French, Italian, Spanish, German, Portuguese, Polish and Romanian. We have not signed up to any code of conduct.
9 Payment
Card payments are processed by MAIB (Moldova Agroindbank), a bank in the Republic of Moldova, through its e-commerce service. You enter your card details on MAIB's secure payment page. We never see or store your full card number. [TO CONFIRM: the cards and payment methods accepted.]
You pay the full price when you order. We send you a receipt by e-mail. [TO CONFIRM: invoice or fiscal receipt requirements under Moldovan law and in the customer's country.]
10 Access and licence
10.1 Access to courses
When the contract is made, the course is unlocked in your parent account at the time described in section 13.2. It stays available to the child profiles in your account for as long as your account is open and Brotelo offers the service. [TO CONFIRM: the access period, for example for the life of the service or a minimum number of years; see also sections 12.3 and 12.4.]
10.2 Your licence
We give you a personal, non-exclusive and non-transferable licence to let the children who have a profile in your account, and you, use the courses unlocked in your account for private, non-commercial learning. You may print certificates. [TO CONFIRM: whether families may print slides or activities for use at home.] The licence ends when your access ends.
10.3 Our content
The courses, illustrations, quizzes, texts, the Bro mascot and the Brotelo name and logo belong to TOPFED WEB S.R.L. or to its licensors. Buying a course gives you access to it, not ownership of it.
11 Certificates
When a child finishes all the slides of a course and its final quiz, Brotelo issues a certificate of completion in that child's profile. [TO CONFIRM: whether a minimum quiz score is needed.]
A certificate of completion shows that the child completed a Brotelo course. It is not a diploma, an accredited qualification or a school grade, and no school or authority has approved it.
The certificate shows the name you choose. We suggest the first name and the initial of the surname, for example "Ana P.". [TO CONFIRM: whether the name can be changed after the certificate is issued.]
Certificates are private by default. You can make a certificate publicly verifiable: anyone who has its code, or who scans its QR code, can then check it on brotelo.com/verify. [TO CONFIRM: the data shown when a certificate is checked; we recommend only the name on the certificate, the course and the date.] You can turn this off at any time, and the code then stops working.
12 Availability and changes to the service
12.1 Availability
We work to keep Brotelo available and secure, but we cannot promise that it will always work without interruption. Maintenance, updates or problems at our providers can cause short outages. We try to do maintenance at quiet times and to announce longer interruptions in advance.
12.2 Updates and changes to courses
We may update courses and the service to correct mistakes, keep facts up to date, improve lessons, add features, fix security issues or follow the law. Updates needed to keep a course in conformity are free.
If a change affects your access to, or use of, a course you bought negatively and more than in a minor way, we will tell you clearly and in advance, by e-mail. You can then end the contract for that course free of charge within 30 days of our message or of the change, whichever is later, and get a refund. [TO CONFIRM: the notice period and the amount refunded in this case.]
12.3 Courses that leave the catalogue
We may stop selling a course. If you have already bought it, it stays in your account [TO CONFIRM: for how long].
12.4 If Brotelo closes
If we decide to stop running Brotelo, we will tell you by e-mail at least [TO CONFIRM: the notice period, for example 90 days] in advance, give you time to save or print certificates, and refund you where the law requires it. [TO CONFIRM: the refund rule if the service closes.]
13 Right of withdrawal and money-back guarantee
13.1 Your right of withdrawal
If you are a consumer, you have 14 days from the day the contract is made to withdraw from the purchase of a course, without giving any reason. Our Withdrawal and refunds page explains how, includes the model withdrawal form and describes the withdrawal function in your parent area.
13.2 Starting access straight away
At checkout, you can give your express consent for access to start straight away, before the 14 days have passed. If you do, you also acknowledge that you lose your right of withdrawal once access has started, that is, once the course is opened for the first time in your account. [TO CONFIRM: the moment access starts, either when the course is unlocked or when it is first opened; the first opening is more favourable to parents.] We confirm your consent and your acknowledgement in the order confirmation e-mail.
If you do not give this consent, [TO CONFIRM: option A: the course is unlocked when the 14-day withdrawal period ends; option B: this consent is a condition for buying].
13.3 Our 30-day money-back guarantee
In addition to your legal rights, we offer a voluntary money-back guarantee: for 30 days after the purchase, you can ask for a full refund of a course as long as no child in your account has completed half of it or more. [TO CONFIRM: owner and lawyer to confirm the guarantee and how "half of the course" is measured.] The conditions are on our Withdrawal and refunds page. The guarantee does not limit your legal rights.
14 If something is wrong with a course
14.1 What we are responsible for
We must supply each course as described and in conformity with the contract and the law: it must match its description, work as described, be fit for the purposes a family would normally expect, and receive the updates needed to keep it in conformity. Courses work in a recent version of a common web browser with an internet connection. [TO CONFIRM: the minimum technical requirements, such as supported browsers and devices.]
14.2 If a course is not supplied
If a course you paid for is not unlocked, ask us to supply it. If we still do not supply it without undue delay, or within an additional period that we expressly agree with you, you can end the contract and get a full refund. You can end it straight away, without asking first, if we have said that we will not supply the course, or if supply by a specific time was clearly essential for you and agreed with us.
14.3 If a course is faulty
If a course is not in conformity, for example if part of it does not work or does not match its description, you can ask us to bring it into conformity free of charge, within a reasonable time and without significant inconvenience to you.
You can ask for a proportionate price reduction, or end the contract and get a refund, if a fix is impossible or would cost us a disproportionate amount, if we do not fix the course within a reasonable time or refuse to fix it, if the problem appears again after our attempt to fix it, or if it is so serious that an immediate price reduction or ending of the contract is justified. You cannot end the contract if the fault is only minor, and it is for us to prove that it is minor.
14.4 Refunds, time limits and cooperation
- We refund you within 14 days of the day we are informed of your decision, using the same payment method you used, at no cost to you.
- We are responsible for a lack of conformity that becomes apparent [TO CONFIRM: during the whole access period if courses are treated as supplied continuously, or within at least 2 years of supply for a one-off supply, with the burden of proof on us during the first year; some countries give longer periods].
- Please cooperate with us, as far as reasonably possible, so we can check whether a problem comes from your device or internet connection. We will use the least intrusive way available.
14.5 Consumers in the United Kingdom
If you live in the United Kingdom, the Consumer Rights Act 2015 gives you rights for digital content: it must be of satisfactory quality, fit for purpose and as described. If it is not, you can ask for a repair or a replacement, or in some cases a price reduction or a refund. If faulty digital content we supplied damages your device or other digital content, you may be entitled to a repair or compensation.
15 Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it would happen, or if both of us knew it might happen when the contract was made.
We do not exclude or limit our liability where the law does not allow it, in particular for death or personal injury caused by our negligence, for fraud, for damage caused intentionally or by gross negligence, and for your legal rights as a consumer, including those described in sections 13 and 14.
As far as the law allows, we are not responsible for:
- loss or damage not caused by our breach;
- events outside our reasonable control, provided we tell you without undue delay and take reasonable steps to limit their effects;
- problems caused by your device or internet connection, or by not following our instructions;
- business losses, because Brotelo is for private family use.
Our courses are for learning. Courses about money, artificial intelligence or other life skills give general education, not financial, legal, medical or other professional advice.
[TO CONFIRM: the liability wording against the consumer law of each target country.]
16 Suspending or closing an account
16.1 Closing your account
You can close your account at any time, in your parent area or by writing to [email protected]. [TO CONFIRM: that account deletion is available in the parent area at launch.] Closing your account deletes your child profiles, their progress and certificates, and ends access to the courses you bought. Closing it does not give a refund on its own, but your rights under sections 13 and 14 remain.
16.2 When we may suspend or close an account
We may suspend or close a parent account, or block a child profile, when this is reasonably necessary because:
- you, or someone using your account, seriously or repeatedly break these terms, for example by sharing or reselling access;
- the law or a decision of an authority requires it;
- there is a risk to the safety of children or to the security of Brotelo;
- there is fraud, or a reasonable suspicion of fraud.
We will tell you the reason in advance and give you a chance to put things right, unless urgency, the law or the safety of children does not allow it. If we close your account and you are not at fault, we refund the courses you bought. [TO CONFIRM: full or proportionate refund in this case.]
We may also close an account that nobody has used for a long time, after warning you by e-mail, as described in our Privacy notice. [TO CONFIRM: the inactivity period, and whether accounts with paid courses are excluded.]
17 Changes to these terms
We may change these terms for a valid reason, such as a change in the law, a new feature or way of selling, security, or to make them clearer.
We will tell you about important changes by e-mail at least 30 days before they take effect, and publish the new version with its date. [TO CONFIRM: the notice period.] The terms that applied when you bought a course continue to apply to that purchase, unless a change is only to your advantage or is required by law.
If you do not agree with a change, you can close your account before it takes effect. If you keep using Brotelo after that date, the new terms apply to your use of the service.
18 Governing law and your consumer rights
These terms, and any dispute about them, are governed by the law of the Republic of Moldova. [TO CONFIRM: the choice of law.] If you are a consumer, this choice does not take away the protection given to you by the mandatory rules of the country where you live.
You can bring a claim in the courts of the country where you live or in the courts of the Republic of Moldova. If we need to bring a claim against you as a consumer, we can do so only in the courts of the country where you live.
19 Complaints and disputes
If you are not happy, please write to [email protected] with your name, your order number if you have one, what happened and what you would like us to do. We confirm receipt within 3 working days and reply in full within 14 days. [TO CONFIRM: the response times.]
[TO CONFIRM: whether Brotelo commits to an alternative dispute resolution body; for consumers in Romania, see the ANPC and SAL information in our Legal notice.] The European Commission's online dispute resolution (ODR) platform was closed on 20 July 2025, so we do not refer to it.
You can also contact the consumer protection authority of your country or go to court.
20 Language of these terms
These terms are published in English, French, Italian, Spanish, German, Portuguese, Polish and Romanian. The English and Romanian versions are the reference versions, and the others are translations. If a translation differs from them, the English and Romanian versions prevail [TO CONFIRM: which version prevails if the English and Romanian versions differ], unless the law of your country entitles you to rely on the version in your language or on the interpretation most favourable to you.
21 Optional: subscription
Not in force. This section will apply only if we introduce a subscription, and only to parents who subscribe. [TO CONFIRM: whether and when a subscription is introduced.]
21.1 What the subscription includes
While your subscription is active, the child profiles in your account can use all Brotelo courses. [TO CONFIRM: whether new courses are included and how many child profiles are covered.]
21.2 Price, renewal and reminders
Before you subscribe, we show the price, the billing period (monthly or yearly) and the total you pay. The subscription renews automatically for the same period until you cancel it. We remind you by e-mail before each yearly renewal. [TO CONFIRM: the reminder timing and national rules on automatic renewal.]
21.3 Right of withdrawal
You have 14 days from the start of the subscription to withdraw. If you gave your express consent for access to start straight away and acknowledged that you lose your right of withdrawal, section 13.2 applies. [TO CONFIRM: whether the subscription is digital content or a digital service, and what a parent who withdraws must pay, if anything.]
21.4 Cancelling
You can cancel at any time in your parent area, in a few clicks, without contacting us. The subscription then ends at the end of the period already paid, and you keep access until then. We do not refund the rest of a period, except where the law requires it.
21.5 Price changes
We may change the subscription price for future periods. We tell you at least 30 days in advance, and you can cancel before the new price applies.
21.6 When the subscription ends
Courses that were available only through the subscription are locked again. The progress and certificates in the child profiles are kept. [TO CONFIRM: that progress and certificates are kept after a subscription ends.]
22 Optional: gift codes
Not in force. This section will apply only if we start selling gift codes. [TO CONFIRM: whether and when gift codes are sold.]
22.1 How gift codes work
A gift code unlocks a course in a parent account. Only an adult can redeem a code, in the parent area. Children cannot redeem codes.
22.2 Buying a gift code
The person who buys a gift code orders it under these terms. The right of withdrawal belongs to the buyer: 14 days from the purchase, as long as the code has not been redeemed. [TO CONFIRM: the withdrawal rules for gift codes.]
22.3 Validity
Each code is valid for the period shown on it. [TO CONFIRM: the validity period, at least 12 months, longer where national law requires it.] A code cannot be exchanged for cash and does not give change.
22.4 Lost or misused codes
Keep your code safe. If you lose a code before it is redeemed, contact us with proof of purchase and we will help if we can. We may block a code obtained by fraud. [TO CONFIRM: the VAT treatment of gift codes as single-purpose or multi-purpose vouchers.]
